In NSW, most estate litigation involves either a family provision claim, or a dispute over the validity of the will.

  • If you have been left out of a will, or the provision for you in a will is inadequate, a family provision application to the Supreme Court enables certain eligible people such as spouses, children and de facto partners, to seek additional provision from the estate.
  • The Court also hears disputes about the validity of the will, for example if there is a question over whether the willmaker had mental capacity to make the will, or was subject to undue influence.
